Terms of Service for Bixter.work.

The terms of service are applicable to Bixter.work services, unless they are waived by written agreement.

Thank you for trusting us at Bixter.work to place agricultural worker(s) with you. We always strive to create value for you and your business.

When Bixter.work receives an order for a recruitment, we spend a lot of resources to find the right employee for you. Bixter.work incurs a number of costs associated with finding employees. There are salaries, payments to partners, marketing and offices in other countries. If Bixter.work does not cover these costs, we cannot find employees for you.

Even though Bixter.work may already have an employee ready to start when you call, it doesn’t mean that getting in touch with the employee has been without cost. This expense must be covered by the recruitment fee paid by you.

When you ask Bixter.work to recruit an employee, we also draw up contracts, route plans, etc. immediately. This is done to ensure that your new employee is no longer looking for a job themselves.

The employee has often budgeted in advance for a number of expenses, such as airfare and the Corona test.

Bixter.work cannot therefore refund the recruitment fee or credit your invoice because you do not need the employee we have recruited for you anyway. Nor can this happen even if the government changes travel restrictions, a flight is cancelled and the employee is delayed or there are other unforeseen changes to plans.

You only pay Bixter.work to recruit an employee. For this service we charge our recruitment fee.

Bixter.work also offers help with paperwork, contracts, route plans, preparing the employee for what it means to work and live in the accepting country, possible application to migration service or registration when the employee is in the accepting country.

These services – which have nothing to do with recruitment – are just extra services, and you can therefore not claim your money back in whole or in part, for example because of an error or shortcoming in a contract or because train and bus times did not match and your employee has to be picked up a little further away.

However, Bixter.work offers – in the vast majority of cases – to recruit another employee free of charge if, for one reason or another, it was not the right match in the first place. This means that you and your new employee must decide together, within the first 30 days, whether you wish to continue working together in the future.

This starting point for our cooperation with you entails the following rules, which apply to our services:

Step by step – the process of dissemination:

Recruitment is booked by telephone and confirmed verbally or by e-mail by Bixter.work. Orders can also be made by e-mail, in which case written confirmation will be sent by the same e-mail. We will immediately start looking for the right candidate for the job. Candidates are recruited via partners around the world and via online marketing. Our skilled staff have extensive experience in finding the right candidates on social media or through networking.

  • Bixter.work will introduce you to one or more suitable candidates.
  • In some cases, Bixter.work will send you the CV of the employee(s). The CV, which is the property of the employee/Bixter.work, is confidential and may not be disclosed to third parties.
  • Once you have accepted an employee, Bixter.work immediately starts the work of drawing up contracts (one for the employee and one for you), making travel and route plans, preparing documents, corona test, biometrics/fingerprints if required, booking appointments for registration of EU workers and possible application to migration service/the Aliens Office. We also prepare the employee on what it is like to live and work in the accepting country and a bit about the area the employee will live in.
  • Bixter.work has free customer service for your new employee, which means that we can take care of a lot of questions, including tax, deductions, residence permits, practical questions, etc.
  • Bixter.work will inform you, as the employer, about the employee’s entry by plane or other form of transport. We always try to have your new employee arrive as close to you as possible, e.g. to the nearest train/bus station, where you can then pick up the employee.
  • Bixter.works services are not subject to the right of withdrawal, in accordance with the legislation on services and trade between traders. We start our work upon order.
  • The recruitment fee charged by Bixter.work is earned by Bixter.work upon ordering the recruitment service and is invoiced upon ordering.
  • In return, Bixter.work provides a guarantee that we will only complete our work for you once you are satisfied with your recruitment. The guarantee means that during the first 30 days from the employee’s start date, we will offer free recruitment of an employee if it turns out that it was not the right match in the first place. You and your new employee must therefore decide within the first 30 days whether you want to work together in the future. After the 30th day, our guarantee expires.
  • However, Bixter.work’s guarantee does not apply in full to trainees and to employment contracts with employees from 3rd world countries. Trainees and employees from 3rd world countries are subject to visa regulations when entering accepting country, and therefore new recruitment of this type of employees will be charged fees to the local Immigration Service/Immigration Authorities.
  • Bixter.work’s guarantee requires that you as the employer provide proper accommodation/living conditions for the employee within the guarantee period, whether the accommodation/living conditions are appropriate is determined solely by Bixter.work. This means that if the employee terminates the employment relationship due to poor accommodation conditions, you as the employer are not sure of being able to use the guarantee.
  • Bixter.work’s guarantee requires that you as an employer notify us within the guarantee period that you wish to make use of the guarantee and want Bixter.work to recruit a new employee.
  • Bixter.work’s recruitment and other services, in connection with the customer relationship, are associated with a wide range of costs, which is why Bixter.work does not – in addition to the guarantee mentioned – provide any form of return.
  • Bixter.work bears no responsibility for the salary and working conditions you agree with the employee. You must report the employee’s social security number to Bixter.work for the purpose of issuing a tax card, and you are reminded that the employee may not commence work with you until the work permit for the employee has been issued.
  • The Bixter.work recruitment fee is payable by the date indicated on the invoice. In case of late payment, interest of 2% per current month will be charged, as well as compound interest until payment is made.
  • Bixter.work can provide assistance with amendment of recruitment contract and other documents required in connection with change of salary and working conditions, but if salary and working conditions are changed, the above-mentioned guarantee will be void.
  • Bixter.work bears no responsibility – in addition to the above guarantee – for any delays in recruitment, issuing residence or work permits, issuing tax cards, the employee’s entry, attendance or start of the employment relationship. Thus, Bixter.work bears no responsibility for the refusal by migration service of an application for a residence permit for the assigned employee, but the relationship falls under the above-mentioned guarantee.
  • Bixter.work bears no responsibility – in addition to the above guarantee – for any shortcomings of the recruited employee, including, but not limited to, his/her possible illness, inability to work or ability to understand and perform the tasks assigned to the employee. Under Danish and EU law, it is prohibited to obtain health information concerning employees.
  • Bixter.work bears – in addition to the above guarantee – no responsibility for force majeure or force majeure-like conditions. This includes, but is not limited to, natural disasters, cold, floods, fire, earthquakes, explosions, accidents, epidemics, pandemics and/or disease outbreaks, strikes, lockouts or other labor disputes, injunctions, war, terrorism, inadequate delivery or service from subcontractors, lack of transportation options, delayed or inadequate delivery due to freight forwarder, export laws or restrictions on energy consumption.
  • Bixter.work bears no responsibility – in addition to the above guarantee – for employees or trainees who start work before the residence permit applied for is valid. A residence permit must be obtained from migration service before an intern or employee starts work, and a new application must be made if an intern or employee moves from an internship to a permanent position. This also applies to a change of place of work or traineeship. It is strongly emphasized that trainees and/or employees covered by these rules may NOT work until permission has been granted by migration service. If they do so, the trainee/ employee and the employer may be fined. In this respect, we refer to www.nyidanmark.dk.
  • Bixter.work cannot be held responsible for any falsified educational documents or CVs of candidates.
  • Bixter.work’s possible guarantee or compensation liability can never exceed the recruitment service invoiced by Bixter.work.
  • Bixter.work can and will refuse to cooperate with employers who do not provide satisfactory accommodation, payment of wages to employees or payment of invoiced services by Bixter.work by the due date.
  • In connection with recruitment, the following duties are incumbent upon the employer:
    • Pick up the employee at the airport or nearest train station.
    • Provide suitable accommodation for the employee.
    • Payment of wages, holiday pay including administration of the discretionary account, payment of A-tax, etc.
    • Taking out statutory work injury insurance.
    • Driving to the train or other public transport in connection with the employee’s registration with the Citizens‘ Service, migration service, etc.
    • Checking bank accounts, ordering a social security number and MitID (other relevant) at the local municipality’s citizen service.
    • Observing the notice periods set out in the employment contract.
  • The customer relationship between Bixter.work and you is governed by Danish law, and any disputes shall be settled by the Court of Aarhus as the place of jurisdiction.
